4. Legal privilege protocol
Legal privilege is a duty of the lawyer and a right of the client. This section explains how it is applied in the firm's practice.
Scope
Privilege covers every fact, document or communication learned by reason of professional practice, including enquiries that do not result in an engagement. The duty survives the conclusion of the matter and is unaffected by the end of the client relationship.
Communications
Routine communications are conducted by email. At the client's request, or where the nature of the matter so advises, an alternative encrypted channel is made available. You are expressly advised not to send case documentation or details of the facts through the forms on this website before a professional engagement has been formalised.
Collaboration with other firms
In Of Counsel and joint-defence engagements, access to the file occurs only after the non-disclosure agreement has been signed. Involvement is limited to the entrusted strand and the firm undertakes in writing a non-solicitation commitment regarding the instructing firm's clients.
Conflicts of interest
A conflict-of-interest check is carried out before accepting any engagement. Where an incompatibility is found, the enquiry is declined and the information received is under no circumstances used.
