Facing criminal proceedings in Spain as a foreign national

Criminal proceedings in Spain are conducted in Spanish and under a procedural code with no direct equivalent in common-law systems. For someone who does not live here — or who does, but has never dealt with a Spanish court — the hard part is rarely the accusation on its own. It is not knowing what stage the case has reached, what has already been decided, and what can still be argued.

This practice acts for non-Spanish clients in proceedings before Spanish courts and before the European Public Prosecutor's Office in Spain. The instruction usually arrives by one of two routes.

Two routes into Spanish jurisdiction

I

You are living in Spain, temporarily or permanently

Residents, expatriates, posted workers, students and second-home owners. A complaint, a road traffic offence, a domestic incident or a company matter is heard by the Spanish court with territorial jurisdiction over the facts, whatever your nationality and however long you have been in the country. Being investigated abroad, in a language you do not speak, changes what defence work is needed — not whether you are entitled to it.

II

You have been brought into Spanish jurisdiction from abroad

Where a case concerns the financial interests of the European Union, Regulation (EU) 2017/1939 allows the investigation to be led by a European Delegated Prosecutor sitting in Spain, even though the company, the funds or the facts may sit in another Member State. The file then runs under Spanish procedural law with the Regulation layered over it — which is precisely where these cases are won or lost.

Directly applicable is not the same as uniform

Regulation (EU) 2017/1939 applies directly, but it does not replace national criminal procedure — it sits on top of it. Spain gave it effect through Organic Law 9/2021, and the seams between the two instruments have left grey areas that are still being settled case by case.

Defending one of these files means working four bodies of law at the same time: the Spanish Criminal Procedure Act, Organic Law 9/2021, the Regulation itself, and the law of each Member State where investigative measures are actually carried out. Getting the applicable rule wrong at the outset is not a detail that can be corrected later — it decides which remedy exists and how long you have to use it.

Rights that are often not explained on day one

An interpreter and a translation of the case file

You are entitled to interpretation at every hearing and to written translation of the essential documents in the proceedings, free of charge and regardless of your means. This is not a courtesy that depends on the court's goodwill; a failure to provide it is a defect that can be raised.

Directive 2010/64/EU, transposed into articles 123 to 127 of the Spanish Criminal Procedure Act

Notification of your consulate

If you are detained in Spain, you may ask that the consular post of your State be informed without delay, and consular officers are entitled to visit and correspond with you.

Article 36 of the Vienna Convention on Consular Relations

A lawyer of your own choosing

Duty counsel is appointed so that nobody is left unrepresented, and it is a real safeguard. It is not, however, the only option: you may appoint counsel of your choice at any point, including before your first statement — which is usually the moment that matters most.

Article 520 of the Spanish Criminal Procedure Act

First contact is with the lead lawyer, in English, and is covered by professional secrecy from the outset.
